If the dispute cannot be resolved through direct negotiation, either party may pursue any available legal or equitable remedy in the courts identified in Section 9 above. Nothing in this Section limits either party's right to seek injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, lawful, and enforceable, and the remaining provisions of these Terms shall continue in full force and effect. The failure of NSMA Group to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
These Terms, together with our Privacy Policy and Fair Housing Statement, constitute the entire agreement between you and NSMA Group with respect to your use of this Site and supersede all prior or contemporaneous communications, proposals, and agreements — whether oral or written — between you and NSMA Group concerning the Site.
